Standards of Behavior for City Facilities, Equipment and Grounds

Purpose Statement

The City of Englewood serves and conducts business with customers and community members in various settings and facilities. An atmosphere of welcome, courtesy, respect, and business is maintained on City Property. These Standards of Behavior protect the rights and safety of visitors, employees and volunteers; prohibit unreasonable interference with others’ lawful use of City facilities; and preserve City equipment, facilities, and grounds.

Unless a specific location is otherwise provided, actions described below violate City Standards of Behavior in all outdoor and indoor areas and structures owned, controlled or operated by the City of Englewood, including City parks, open spaces, recreation facilities, pools, and buildings/libraries (collectively referred to as “City facility[ies]”). Warning, removal, and exclusion for violation of these Standards are supplemental to all other actions authorized by law, such as criminal charges.


TIER 1

INAPPROPRIATE BEHAVIOR MAY RESULT IN WARNING, IMMEDIATE REMOVAL AND/OR REMOVAL/EXCLUSION UP TO 90 DAYS. 

DISRUPTIVE ACTIVITY/BEHAVIOR (such as unreasonable and excessive noise, music, voices or other media) interfering with normal use/operation of a City facility by another.

LITTERING

IMPEDING use of walkways, common areas, exits or entrances, or use of a City facility by another.

Creating a RISK TO PUBLIC HEALTH OR SAFETY, including through bodily fluids, feces and pests.

Bringing in PERSONAL POSSESSIONS that pose a threat to public health or impede the use of the facility.

Leaving PERSONAL PROPERTY UNATTENDED in a City building, including bags and backpacks.

Failure to wear CLOTHING covering the upper body and genitalia, or failure to wear SHOES in a City building. Using RESTROOMS in a City building for shaving, bathing or laundry.

SITTING/LYING in City buildings other than on furniture designed for that purpose.

Bringing ANIMALS into a City facility marked animals prohibited or into any City building, except ADA service animals or as specifically authorized by the City, unless the animal is not under the person’s control at all times or the animal urinates/defecates in a City building.

RIDING SKATEBOARDS, ROLLER SKATES, BICYCLES OR SCOOTERS inside a City building, except ADA assistive devices or as specifically authorized by the City.

FAILURE TO COMPLY with reasonable staff requests, including refusal to promptly exit at closing.

VIOLATION OF A CITY PARK RULE OR REGULATION, where those are applicable.

OTHER Tier 1 Violations added by order of the City Manager, or established and posted for a specific City facility


TIER 2

PROHIBITED BEHAVIOR WILL RESULT IN WARNING, IMMEDIATE REMOVAL AND/OR REMOVAL/EXCLUSION UP TO 180 DAYS

DRUG POSSESSION, selling, distributing, consuming, or under the influence of any illegal drug or associated paraphernalia.

MARIJUANA/TOBACCO consumption, including smoking, vaping and e-cigarettes, inside City buildings.

ALCOHOL consumption/under the influence of alcohol inside City facilities/buildings.

Public viewing of SEXUALLY EXPLICIT OR PORNOGRAPHIC MATERIALS.

URINATION, DEFECATION, other than in a toilet.

Physical ALTERCATIONS, including assault, attempted assault.

Obscene, profane, lewd, threatening, abusive or disparaging LANGUAGE, slurs, epithets, GESTURES or BEHAVIORS directed at another, knowing or with reasonable grounds to know it will tend TO PROMOTE/PROVOKE A FIGHT.

VIOLATION OF ANY APPLICABLE CRIMINAL LAW at a City facility, including, but not limited to carrying a concealed knife or firearm, unless authorized by law; displaying a knife or firearm to  intimidate, or in a manner that creates alarm for safety of others; sexual conduct including sexual activity, simulated sexual acts, indecent exposure.

THREATS (including threatening display of any item as a weapon), INTIMIDATION, HARASSMENT (including sexual, written, verbal, or physical harassment, or prolonged staring or following another with intent to harass, or stalking) of others. 

VANDALISM, THEFT, DAMAGE, OR DESTRUCTION OF City or another’s PROPERTY.

OTHER Tier 2 Violations added by Order of the City Manager, or established and posted for a specific City facility.


RESPONSES TO STANDARDS OF BEHAVIOR VIOLATIONS occurring within/related to the use of City facilities may include:

  • Verbal warning to discontinue the behavior.
  • Ejection (verbal or in writing) requiring you to immediately leave the City facility where the behavior occurred and not return for 24 hours.
  • Exclusion (in writing) prohibiting you from entering or remaining at the City facility where the behavior occurred starting four days after
    issuance, for the following time period:
    • TIER 1 Violation: May be for up to 45 days, unless you have one prior exclusion in last three years from any City facility,
      then may be for up to 60 days. If multiple prior exclusions in last 3 years, may be for up to 90 days.
    • TIER 2 Violation: May be for up to 90 days, unless you have one prior exclusion in last three years from any City facility,
      then may be for up to 120 days. If multiple prior exclusions in last 3 years, may be for up to 180 days.
  • In addition to any ejection and/or exclusion, law enforcement may be called and a citation may be issued.
